Stopping the sale of counterfeit toys for a large online store
Problem
The need to block an offer for sale of counterfeit products on the Internet through the administration of marketplaces (Ozon, Wildberries, Yandex.Market, AliExpress) and online classifieds (Avito). The need to carry out controlled purchases of goods offline in the territory of Moscow, the Moscow Region (Sadovod, Dubrovka, etc.) and in other regions of Russia (St. Petersburg, Omsk, Kaluga, Vladivostok), as well as in chain stores (1C, Detsky Mir, Buy an Elephant), to seek the removal of counterfeit goods from sale

Project work
The full conduct of claim work included:
  • Providing controlled purchases, preparing and filing claims, negotiating and concluding agreements with large networks of violators (1C, Detsky Mir, Buy an Elephant)
  • Fixing violations, preparing and submitting claims to all marketplaces (Ozon, Wildberries, Yandex.Market, AliExpress), more than 1,000 pieces in total. Along with the claims, the conclusions of the patent attorney were prepared and submitted as evidence of the violation

The result and benefits for the client
The fight against counterfeiting made it possible to increase sales by 40%, as well as allow one to remain a monopolist (7 out of 10 toys offered for sale on marketplaces are original
Successful fight against the sale of counterfeit goods by a distributor with an annual income of over 2 billion rubles
Problem
The client is the copyright holder of Chiaro, De Markt, and MW-Light trademarks and an exclusive representative of the German manufacturer Regenbogen. There were problems with the sale of counterfeit products (copies from China), as well as with products imported as part of parallel imports in violation of the terms of exclusive distribution of the client. The number of violators on OZON and Wildberries marketplaces was significant

Project work
Conducting full work to identify and suppress violations:
  • Search for violations on marketplaces and on the Internet, weekly monitoring and reporting
  • Preparation and submission of claims, registration of patent attorney opinions for the Wildberries administration
  • Negotiations with violators, conclusion of pre-trial agreements. In total, claims in the amount of 244 million rubles were sent to 244 violators, of which 241 were satisfied voluntarily

The result and benefits for the client
The client was able not to burden the internal legal service with claim work, as well as the marketing department with the tasks of searching for violators. The average time saved by these departments is more than 300 hours of work of employees per month
